The Rubin Law Corporation recently settled a $900,000 multiple employee action on behalf of several current and former machinery technicians of a major southern California service company. Many of the technicians had been working for the company for over 10 years, working seven days a week and in excess of 12 hours per day without overtime pay and compensation for missed meal and rest periods. Shortly after these technicians hired this firm, we were able to freeze the statute of limitations on their claims by signing a tolling agreement with the employer (thereby preserving months worth of overtime pay for our clients) and asserting a written demand for compensation. The firm was able to settle the case just three months later while avoiding a costly and time-consuming lawsuit. The experience was meaningful to our clients not only because they were compensated for their years of hard work but also because they contributed to substantial corporate policy changes. As a result of this action, the company now pays each technician their overtime wages, gives every employee an uninterrupted 30-minute meal break, and a 10-minute rest break for every 4 hours worked.
