The proposed plaintiff class consists of all current and former in-store employees of Sunglass Hut locations across California, who allege that the company customarily denied its employees their right to a 10 minute rest period and 30 minute meal break. This case is illustrative of the penalties and fines that can apply when an employer violates the wage and hour provisions of California's Labor Code. Because of the company's alleged failure to provide an uninterrupted 30-minute meal break every 5 hours and a 10 minute rest period every 4 hours, the plaintiffs maintain separate causes of action against the company for unpaid wages, waiting time penalties, and inaccurate wage statements.
